The final case examined is the MV Norstar which marks the twenty fifth and most recent case of the International Tribunal for the Law of the Sea. The MV Norstar is a Panamanian Vessel which was responsible for delivering “gasoil to mega yachts in international waters beyond the territorial sea of Italy, France, and Spain” between 1994 and 1998 (Press Release 241). The ship was arrested by Spanish officials on September 24th, 1998 due to the suppling of oil in contravention of Italian legislation. On December 17th, 2015 Panama submitted an application to the Tribunal which requests “compensation from Italy for damage caused by the illegal arrest of the MV Norstar in 1998” (Press Release 201). In support of its request, Panama contends that Italy violated several provisions of the United Nations Convention on the Law of the Sea, in particular the right of freedom of navigation. After being reviewed by the tribunal, Italy filed preliminary objections on March 11th, 2016. The Tribunal issued a formal date for the hearing which will take place later this year. The Panamanian government will express its concerns regarding the destruction of property on May 10th. On July 9th, the Italian government will have a chance to voice their opinion and views on the matter.

While this case has not yet been concluded, it depicts the steps taken in order to effectively handle international relations. A formal and factual approach must be taken throughout all stages of a case in order to ensure that both countries involved are given equal opportunities to defend themselves.
